1. Introduction

1.1 The following sets out the Terms and Conditions for Next Gen Giveaways Ltd (“Next Gen”), a company registered in the United Kingdom under the registration number 1666730 and a registered address 42-44 Leppings Lane, Sheffield, England, S6 1ST.

1.2 These Terms and Conditions apply in whole to all individuals and entities who use, interact with, make a purchase or simply visit our website (“Site”) (https://www.nextgengiveaways.co.uk/).

1.3 By visiting our Site, and/or entering a Prize Draw, you agree to the applicability of these Terms and Conditions to the contract between you and Next Gen. For this reason, it is important that you take your time to read this document carefully.

1.4 All Prize Draws available on this Site are for the UK residents only.

2. Description

2.1 At Next Gen, we offer a wide range of Prize Draws that aim to benefit the next generation of children, to give them a better childhood.

2.2 Our Site is designed to allow visitors (“Users”) to browse the Site and enter Prize Draws, becoming participants (“Participants”).

3. Age Restrictions

3.1 Users may only enter Prize Draws through this Site if they are at least 18 years of age.

3.2 None of the Prize Draws on this Site may be purchased by anyone under 18 years of age.

4. Creating an Account

4.1 To create an account a User must provide the following:

  1. Your name;
  2. Your email address;
  3. Your phone number; and
  4. Your date of birth.

4.2 Please note that it is not necessary to create an account to enter the Prize Draw using the free entry option.

5. Entering a Prize Draw: Prize Draw Process

5.1 To enter a Prize Draw a User must EITHER:

  1. Sign up for a free account, where they must record their age (please see above for more information in relation to creating an account).
  2. Enter their chosen Prize Draw(s).
  3. Allocate their tickets (each prize Draw has a finite amount of tickets available for purchase with a maximum limit per Participant set by Next Gen).
  4. Purchase a ticket(s).
  5. Once payment is successful, the Participant is shown the confirmation page, and the tickets are available to view in their account page.
  6. or enter via a free postal entry (instructions for which are provided on our Site).

6. Ticket Allocation

6.1 When a User chooses a ticket amount and presses the 'buy tickets' button, the number of tickets chosen is created and ticket numbers are randomly assigned between '1' and the maximum number of tickets for that Prize Draw that haven't already been assigned.

6.2 When a User enters the Prize Draw using the free entry method, each postal entry equates to one ticket. Similar to paid tickets, ticket numbers will be randomly assigned between '1' and the maximum number of tickets for that Prize Draw that haven't already been assigned.

7. Ending a Prize Draw

7.1 Each available Prize Draw will be open for a specified amount of time. Once a Prize Draw has ended, entries are closed and tickets cannot be purchased or free entry tickets accepted.

8. Drawing the Winner(s)

8.1 Upon the close of a Prize Draw, Next Gen will review all tickets (this includes adding any free ticket entries manually), before using a number generator to randomly select the winning ticket.

8.2 A live Prize Draw will be streamed on the Next Gen Giveaways' Facebook page where the winning ticket number will be selected.

8.3 Once randomly generated, the ticket will be matched to the relevant Participant, where they will be contacted and their age and ID will be verified before the Prize is released to them.

8.4 Please note that Prizes are non-transferable, non-refundable and no cash or other alternative will be provided, except at the promoter's sole discretion.

9. Cancellation and Refunds

9.1 In accordance with the UK Gambling Commission and UK Online Distance Selling rules, Next Gen will not offer a refund or cancellation (including a 14 day cooling off period) for any tickets bought or Prize Draws entered (including using the free entry process).

9.2 They may however, at their sole discretion offer a refund if the Prize Draw materially changes.

9.3 Next Gen will refund a paid Participant if the Prize Draw is cancelled. Next Gen will not however, be in a position to offer Participants using the free entry process any compensation should the Prize Draw be cancelled.

10.1 Links to other sites may be included on our Site. Unless expressly stated, these sites are not under Next Gen's control. Next Gen neither assumes nor accepts responsibility or liability for the content of third-party sites. This inclusion of a link to another Site is for information only and does not imply any endorsement of the sites themselves or of those in control of them.

11. Acceptable use policy

11.1 This Site must only be used in compliance with these Terms and Conditions. You must not:

  1. Use this Site in a manner that is unlawful or fraudulent;
  2. Knowingly cause harm to the Site by uploading, sending or in any other way transmitting data that contains any form of virus or malware or any other code designed to adversely affect computer, hardware, software, or data of any kind; or
  3. Knowingly cause any harm to any other user to our Site.

12. Changes to these Terms and Conditions

12.1 Next Gen may alter these Terms and Conditions at any time. If we decide to do this, any such changes will become binding on all Users when using and/or browsing our Site. All Users are therefore advised to check this page and read our Terms and Conditions upon every visit to our Site.

13. Data Protection, Privacy and Cookies

13.1 These Terms and Conditions have been drafted in line and in accordance with the UK Data Protection Act 2018 (“DPA'18”), the UK General Data Protection Policy (“GDPR”) and the Data Use and Access Act (“DUAA”).

13.2 Use of this Site is governed by our Privacy Policy and Cookie Policy which can be found here [insert links]. These polices are incorporated into these Terms and Conditions by this reference.

14. Severability and Waiver

14.1 If any provisions of these Terms and Conditions are found to be unlawful, invalid or otherwise unenforceable by any court or other authority, these provisions shall be deemed severed from the remainder of these Terms and Conditions. The remainder of these Terms and Conditions shall be valid and enforceable.

15. Law and Jurisdiction

15.1 These Terms and Conditions, and the relationship between Next Gen and Participants or Users of our Site (whether contractual or otherwise) shall be governed by, and construed in accordance with, the law of England and Wales.

15.2 Any disputes concerning these Terms and Conditions, the relationship between Participants, Users and Next Gen, or any matters arising therefrom or associate therewith (whether contractual or otherwise) shall be subject to the jurisdiction of the court of England and Wales.
